Terms & Conditions

Welcome to Artkery. Artkery is an AI-powered creative platform operated by Artkery Korea (for users residing in the Republic of Korea) or WithMeLive Inc. (for all users outside Korea) (collectively referred to as “Artkery”, “we”, “us”, or “our”). These Terms & Conditions apply to your use of all services provided on Artkery.com, including AI generation tools, ChainProof blockchain registration, file processing features, and all related products.

If you reside in the Republic of Korea, you are entering into an agreement with Artkery Korea, and Korean law will govern your use of the service. If you reside outside Korea, you are entering into an agreement with WithMeLive Inc., a Delaware corporation, and your use of the service is governed by the laws of the State of Delaware, U.S.A., regardless of conflict-of-law principles.

By accessing or using this website or any Artkery services, you acknowledge and agree to be bound by these Terms & Conditions. Please read them carefully. If you do not agree, you must discontinue use of the site immediately.

These Terms may be updated from time to time. Continued use of Artkery following any updates constitutes acceptance of the revised Terms.

1. Acceptable Use of Artkery

You agree to use Artkery only for lawful and ethical purposes. You may not upload, generate, or distribute content that is illegal, harmful, abusive, explicit, defamatory, infringing, or intended to mislead others. This includes deepfakes, impersonation, or copyrighted materials without permission.

Artkery reserves the right to remove content or restrict access if your usage violates these guidelines.

2. User Content & Upload Responsibility

You are fully responsible for any files, prompts, images, videos, or other content uploaded to Artkery (“User Content”). By uploading content, you confirm that you own the rights or have obtained appropriate permission.

You grant Artkery a non-exclusive, worldwide license to process and use your content solely for providing AI generation or ChainProof services. You retain full ownership of your original files.

3. AI Output License & Limitations

AI-generated results (“AI Outputs”) may resemble existing works due to the nature of generative models. Artkery does not guarantee the uniqueness, exclusivity, or non-infringing nature of AI Outputs.

You are responsible for verifying suitability and legal compliance before commercial use. Artkery is not liable for copyright or legal issues arising from AI Outputs.

4. ChainProof Blockchain Registration

Artkery offers blockchain-based verification services that permanently store hashed metadata or original file references on-chain. Once recorded on the blockchain, entries are irreversible and cannot be modified or deleted.

Blockchain confirmation times may vary. Delays caused by network congestion, gas fees, node outages, or external blockchain providers are outside Artkery’s control.

Users are responsible for ensuring accuracy of submitted metadata before registration.

5. Credits, Billing & Refunds

Artkery uses a credit-based system. Credits are deducted for AI generation, ChainProof registration, and premium features. Credit prices may vary based on the selected model or tool.

Used credits are non-refundable. Unused credit packages may be refunded within 14 days of purchase, provided no credits have been consumed.

Subscription or promotional credits may have expiration dates.

6. Limitation of Liability

Artkery provides all services “as is” without any warranty, expressed or implied. We are not responsible for loss of data, financial damages, business interruption, or legal issues arising from your use of AI Outputs, uploaded files, or blockchain registration.

You assume all risks associated with using third-party AI providers integrated into Artkery.

7. Account Termination and Suspension

Artkery may suspend or terminate accounts without prior notice for reasons including:

  • Abusive or harmful behavior toward staff or users
  • Fraudulent, illegal, or suspicious activity
  • Unauthorized resale of Artkery services
  • Generation of harmful or prohibited content
  • Account compromise or security risks

Terminated accounts are not eligible for refunds of used credits.

8. Privacy Policy

Artkery respects your privacy. We do not sell or rent personal information. Your data is used only for essential functions such as order processing, account management, billing, fraud prevention, and legal compliance.

9. Third-Party Services & Integrations

Artkery integrates with third-party AI models, cloud providers, blockchain networks, and external APIs. We do not control and are not responsible for outages, delays, errors, or damages caused by these external services.

Users agree that Artkery is not liable for failures resulting from third-party infrastructure, blockchain congestion, or API limitations.

10. Indemnification

You agree to indemnify and hold harmless Artkery, its employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Violation of these Terms
  • Violation of third-party rights
  • Content you upload, generate, or distribute

11. Age Requirement

Artkery is intended for users age 13 and older. If you are under 18, you may only use Artkery with parental or guardian consent. By using the service, you confirm that you meet these age requirements.

12. Prohibited Use

In addition to previous restrictions, you explicitly agree NOT to use Artkery for:

  • Harassment, threats, personal attacks, or discrimination
  • Violence, self-harm, or illegal activities
  • Medical, legal, or financial advice generation
  • Political propaganda or election manipulation
  • Malicious code, malware, or cybersecurity attacks
  • Automating large-scale scraping or unauthorized API usage

13. Force Majeure

Artkery is not liable for delays or failures caused by circumstances outside our reasonable control, including natural disasters, war, cyberattacks, government actions, power outages, or major internet disruptions.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and in full effect.

15. Modifications to Terms

Artkery may modify these Terms at any time. Changes take effect immediately upon posting on the website. Continued use of the service indicates acceptance of the updated Terms.

16. Entire Agreement

These Terms constitute the complete and exclusive agreement between you and Artkery, superseding all prior agreements, understandings, or communications.
